Duo taken into custody after they passed out at an Elk County McDonald’s drive-through while their kids were inside

Two individuals were apprehended in Elk County after authorities discovered them under the influence of drugs and unconscious in a McDonald’s drive-thru, with two children present in their vehicle.

According to a criminal complaint, Alexis Pisani, 29, from Johnsonburg, and Dakota Depto, 23, from Kane, were arrested by officers from the City of Saint Marys Police Department. The officers responded to a call about two individuals who were passed out and parked in the drive-thru of a McDonald’s.

On July 29, authorities were dispatched to the fast food establishment after an employee reported a Toyota Sienna parked in their pickup position. The employee informed authorities that Pisani and Depto were “nodding out” in the drive-thru and took more than 10 minutes to pay. The affidavit states that Pisani was “bent like a pretzel,” with her head touching her knees and Depto’s head over the steering wheel.

According to the charges filed, police spoke with Depto and discovered he had a suspended driver’s license as a result of a previous DUI. Officers then discovered two youngsters, an eight-year-old and an eleven-year-old, in the car.

According to the complaint, they acquired a search order for the vehicle and discovered xylazine, fentanyl, and fluoro fentanyl. They also allegedly discovered drug paraphernalia such as syringes, a spoon, burnt foil, a clear glass pipe, a metal pipe, and numerous empty packets of heroin/fentanyl.

Police reportedly discovered garbage cans in front of one of the youngsters and between them, which allegedly contained empty drug bags and other drug paraphernalia.

The affidavit mentioned Depto as being under the influence of amphetamines, methamphetamines, fentanyl, and norfentanyls.

Depto faces felony accusations of endangering children’s welfare, as well as misdemeanor charges of DUI, avoiding arrest, intent to possess a controlled substance, and other connected crimes. He is still awaiting arraignment, according to court records.

Pisani is being held in Elk County Prison on $7,500 bail. She is charged with misdemeanors that include endangering the welfare of minors, possessing a controlled substance with intent, and using drug paraphernalia.
