A Columbiana County Man Files A Lawsuit To Stop Democrats From Replacing Joe Biden As Presidential Candidate

A Columbiana County man has filed a lawsuit, saying that allowing Vice President Kamala Harris to replace President Joe Biden on the November ballot is illegal.

Don Vos of Washington Township filed a lawsuit in the United States District Court, seeking a restraining order or permanent injunction to prevent the Ohio Secretary of State from permitting Democrats to list any name other than Joseph Biden as their presidential nominee.

“As Joe Biden bowed out of the race for president, the only two people that can be in the race are Kennedy and Trump,” Vos writes in his grievance.

Vos cites Article I, Section 20 of the Ohio Constitution’s Bill of Rights to bolster his position.

“This enumeration of rights shall not be construed to impair or deny others retained by the people; and all powers, not herein delegated, remain with the people.”

Vos, who filed the action without an attorney, claims that no provision in the state constitution permits a president to withdraw from the campaign and be replaced by another Democrat.

The lawsuit claims that Democratic National Convention delegates selected their presidential choice using computerized ballots ahead of this month’s national convention in Chicago.

According to the Associated Press, Harris is the only qualifying candidate who met the Tuesday deadline.
