A Biden rule that would have enabled thousands of DACA recipients to access Obamacare has been suspended by a federal court. On Monday, the court awarded an injunction that was brought by Kansas Attorney General Kris Kobach and a 19-state coalition.

This occurs subsequent to Kobach’s advocacy for a preliminary injunction in October. The hold will remain in effect until a final decision is reached.
Kobach contended that the Biden administration’s policy would have permitted migrants who are unlawfully present in the United States to obtain taxpayer-subsidized health insurance. According to him, a 1996 law forbids them from obtaining federal benefits, and he contended that Obamacare itself stipulates that individuals must be lawfully present in the United States to qualify for subsidized health insurance.
The regulation would have made over 200,000 deferred action for childhood arrival (DACA) recipients eligible for Obamacare, according to the state Attorney General’s Office. They stated that the figure encompasses over 4,350 DACA recipients in Kansas.
Kobach was the leader of a coalition of state attorneys general, which included AGs from Alabama, Arkansas, Idaho, Indiana, Iowa, Florida, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia.
